InControl Terms and Conditions

These Terms and Conditions (the Terms) govern your use of the InControl iOS app and related services (the Service). By accessing or using InControl, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use InControl.

If you are under the age of majority in your location, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Account registration and security

To use certain features, you may need an account. You agree to:

• Provide accurate and current information
• Keep your credentials secure
• Be responsible for activity under your account
• Notify us promptly of suspected unauthorized use

We may suspend or terminate accounts that violate these Terms or present security or risk concerns.

3. Service description

InControl is a productivity and focus app that may include features such as:

• Task planning and management
• Focus session tracking
• Progress and streak tracking
• Optional calendar-based workflows
• Personalization and onboarding preferences
• Subscription-based premium features

Features may change over time.

4. Subscriptions and billing (Apple)

Certain features may require a paid subscription.

• Subscriptions are offered through Apple In-App Purchase.
• Billing, renewals, cancellation, refunds, and payment methods are handled by Apple under Apple’s terms and policies.
• We do not directly process or store your payment card information.
• If you cancel, access to paid features typically continues through the end of the active billing period.

5. Acceptable use

You agree not to:

• Use the Service for illegal, harmful, or fraudulent activity
• Attempt to reverse engineer, exploit, disrupt, or interfere with the Service
• Circumvent technical limits, security controls, or subscription protections
• Use bots or automation in a way that harms the Service
• Upload or transmit malicious code
• Infringe intellectual property or other legal rights

6. User content

You retain rights to content you submit (for example, tasks, notes, preferences, and profile content).

You grant InControl a non-exclusive, worldwide, royalty-free license to host, process, and use your content solely to operate, maintain, improve, and secure the Service.

You are responsible for ensuring your content does not violate laws or third-party rights.

7. Intellectual property

The Service, including app design, software, branding, and related materials (excluding your content), is owned by or licensed to InControl and protected by applicable intellectual property laws.

Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from the Service.

8. Privacy

Your use of the Service is also governed by the InControl Privacy Policy, which describes how we collect, use, and disclose information.

9. Service availability and changes

We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice, including to improve functionality, security, or compliance.

We do not guarantee uninterrupted or error-free operation.

10. Termination

You may stop using the Service at any time and may delete your account through in-app deletion tools.

We may suspend or terminate access if:

• You violate these Terms
• Required by law
• Needed to protect users, the Service, or third parties

Upon termination, provisions that by nature should survive, including those covering intellectual property, disclaimers, and limitation of liability, will survive.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will always be available, secure, or error-free
• Data loss will never occur
• Results from using the Service will meet all expectations

12. Limitation of liability

To the maximum extent permitted by law, InControl and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business interruption, arising from or related to your use of the Service.

Where liability cannot be fully excluded, liability is limited to the maximum extent permitted by applicable law.

13. Indemnification

You agree to defend, indemnify, and hold harmless InControl from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any law or third-party rights

14. Changes to Terms

We may update these Terms from time to time.

If changes are material, we may provide notice through the app, email, or other reasonable method.

By continuing to use the Service after updated Terms become effective, you agree to the updated Terms.

15. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law.

These Terms and the Privacy Policy form the entire agreement between you and InControl regarding the Service, replacing prior agreements on the same subject matter.
